6 This very brief historical sketch of the evolution of cross-border social and commercial flows since 1973 shows that the socio-economic normalization of the Irish border is not only the result of European decisions and influences. Above all, it is a direct result of the evolution of relations between London and Dublin on the issue of Northern Ireland in the wider context of Europe. The Irish border, which has been an intra-European border since 1973, has facilitated the two states and communities of Northern Ireland to reach a well-balanced political compromise on the whole of Ireland and on the internal dimensions of the Northern Ireland problem.4 During the riots, there were army barracks, police posts and fortified guard towers along the border. They have often been attacked by Republican paramilitaries. 53 The NSMC was established in 1998 to develop consultations, cooperation and actions between the Northern Ireland Executive and the Government of the Republic across Ireland and cross-border issues. The European Union`s Brexit task force has informed us that the CTA is an agreement between two EU Member States and that it is protected by the European Union Protocol (it is currently annexed to the Lisbon Treaty) that it would no longer apply if the UK was not banned from the EU.70 On the other hand, Professor Ryan felt that there was no obvious legal reason for Ireland not to retain this advantage after the UK left the EU. EU legislation (Protocol 20 of the Treaty on the Functioning of the European Union) allowed the United Kingdom and Ireland “to continue to conclude agreements between them on the movement of persons between their territories [the CTA] and to keep these rules outside the Schengen area.72 It seemed clear that the UK should negotiate a special status (at least for Irish citizens) in the event of Brexit. Any bilateral agreement between the UK and the Republic on the border should be approved by the other EU Member States, As Professor Dagmar Schiek, Jean Monnet President of EU Law and Policy at Queens University Belfast, said: “Under EU law, any future relationship between the Republic of Ireland and the United Kingdom would be agreed not only with the Republic of Ireland, but also with the EU as a whole.73 A standardization of security measures and practices can and should mean. The Irish backstop has set up British political parties. But what is interesting is that Northern Ireland as a whole is pretty good with the backstop as it is, or at least some kind of special regime to avoid a hard border.
In October 2016, the Guardian reported that British proposals to avoid a hard border by “transferring the front line of [British] immigration controls to Irish ports and airports had received “signals of support” from some members of the Enda Kenny government.
